Age Restrictions
All wines are sold in California and title passes to the buyer in California. In California, law prohibits the purchase of alcohol by persons under the age of 21. HENCE, ALL ALCOHOL ORDERS MUST BE PLACED BY A PERSON 21 YEARS OF AGE OR OLDER. By using this site you swear and affirm that you are over the age of 21. WineSavage makes every effort to ensure that alcoholic beverages are not delivered to anyone who is under the age of 21. By using this site you are acknowledging that the person receiving a shipment of alcoholic beverages from WineSavage is over the age of 21. Verification of age is required at the time of delivery. Failure to produce age verification forfeits the right to receive the shipment until identification is produced. Customer comments on their order such as "Please leave on back porch" or "Please leave at front door" will be ignored!
It is recommended that you have your order shipped to a work address, or one where an adult will be available to sign for your shipment. IN THE EVENT THAT NO ONE IS AVAILABLE TO RECEIVE THE SHIPMENT AFTER THREE DELIVERY ATTEMPTS, THE CARRIER WILL RETURN THE SHIPMENT TO THE SENDER AND YOU WILL BE CHARGED A SHIPPING RETURN FEE OF $35. If at that time you wish to have the order re-shipped, you will be billed again for the cost of shipping the box.
If you do not agree with these conditions of use please do not use this site. If you intentionally or unintentionally misrepresent your age in order to provide alcohol to a person under the age of 21, WineSavage may prosecute you fully to the extent allowable by law.
Legal Disclaimer
You assume and take title to your order in California upon purchase. You are responsible for the shipment of all orders you place with WineSavage. By placing an order, you authorize Winesavage to act on your behalf to engage a common carrier (i.e., UPS) to deliver your order where you want it delivered. WineSavage acts only as your agent for the shipping/delivering of your order. We make no representation to the legal rights of anyone to ship or import any wine/champagne into any state. You are solely responsible for the shipment of your order and for determining the legality and the tax/duty consequences of having your order shipped to the recipient. Once the order has left our facility, the buyer is solely responsible for any loss or damage.

User Obligations
You agree not to do any of the following while using the WineSavage site:
- Intentionally or unintentionally violate any applicable law or regulation.
- Access, tamper with, or use nonpublic areas of the WineSavage site or WineSavage computer systems.
- Unauthorized individuals attempting to access or tamper with these areas may be subject to prosecution.
- Frame or link to the WineSavage.com site except as permitted in writing by WineSavage
Wine is a heat-sensitive products. WineSavage makes every effort possible to ship our orders in conditions that are safe for the contents. We typically ship on Mondays to ensure packages can arrive safely at their destinations before the end of the week.
During warmer months, we strongly recommend upgrading to 2-Day Air or Next Day Air to prevent damage to the alcohol.
We reserve the right to hold shipments during especially hot periods, but we cannot take responsibility for product damaged in transit due to heat exposure.
Cancellations Policy
Most orders ship within 3 business days. Should you wish to cancel an order you may do so however all cancelled orders are subject to a 25% restocking fee. This includes orders that customers have requested to be held in our warehouse for future shipment.
If your order has already shipped but has not yet been received, shipping charges will not be refunded. Please contact Customer Service at orders at WineSavage.com. If it has already shipped you will be asked to refuse the order when it arrives and when the merchandise is received back at our warehouse you will be refunded for the purchase price and sales tax less the restocking fee.
Our Return Policy
If you are not completely satisfied with your purchase, please contact Customer Service within 30 days of receipt of your purchase at orders at Winesavage.com. We allow products to be returned only if the product is defective.
WineSavage cannot guarantee the condition of any product if the order is not received the first time FedEx or UPS delivers. If there is no one home to sign for it, the box may get held in a FedEx or UPS facility that is not temperature controlled. By California State Law return of alcohol products can only be for exchange of the identical product or for store credit. There is no cash, check or credit card refunds under any circumstances.
We ask that you retain the original shipping boxes and inserts in order to facilitate any return shipments. We reserve the right at our sole discretion to determine whether or not products are defective. Empty bottles are never considered defective product.
Undeliverable Shipments
If the carrier is unable to deliver the order, and the box is returned to us, you will be notified and a return shipping and restocking fee of $35 will be charged to you. When a replacement address is provided, a $10 reshipping fee will be charged, plus the actual transportation charges.
Third Party Content and Monitoring
Any opinions, advice, statements, services, offers, events or other information or content expressed or made available on this WineSavage.com site by third parties (including information providers and users) are those of the respective author(s) or distributor(s) and not of Winesavage. WineSavage neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, information, or statement made on this WineSavage.com site by anyone other than authorized WineSavage employees acting in their official capacities.
Parental Control Protections
As required by the Communications Decency Act of 1996, WineSavage hereby notifies you that parental control protections (such as computer hardware, software, or filtering services) are commercially available that may assist you in limiting access to content that may be harmful to minors. Among the many companies that provide Internet blocking and screening software are CyberPatrol, NetNanny, SurfWatch, and GuardOne. WineSavage does not sponsor or endorse any of these companies or their services.

You acknowledge and agree that Winesavage is not responsible or liable for (1) the availability or accuracy of such web sites or resources; or (2) the content, advertising, or products on or available from such web sites or resources. No Responsibility to Sell Mispriced Products or Services
WineSavage.com shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. WineSavage shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, WineSavage shall immediately issue a credit to your credit card account in the amount of the charge or offer a store credit.
WineSavage reserves the right to change these terms and conditions from time to time in its discretion.
